Good Neighbour Policies for Condo Dwellers

Perhaps the poet Robert Frost said it best when he wrote: "Good fences make good neighbours." But that advice is tough to follow when living in a new condo. High-density housing can require a greater level of patience and a willingness to tune out the distractions of our neighbours' daily lives.

Many new condominiums offer purchasers of condominium units the option of getting a balcony or patio with the unit and these spaces are often legally defined as exclusive use common elements. This means that although this area is only used by the unit owner and not other unit owners, it is still a common element and is governed by the rules of the condominium corporation. As a lawyer practising condo law, I can verify that a condominium corporation with realistic rules and guidelines--along with consistent enforcement--makes for good neighbours. Here are some helpful reminders for new condo owners and board members:

  • Summer barbeques are always fun, but can create safety hazards and trigger nuisance complaints. Does your building have any restrictions on the use of outdoor grills on patios or balconies? What are the rules for using shared barbecue facilities?
  • Hanging baskets, window boxes and patio gardens brighten up a space with flowers. Are there any restrictions on plants and décor items that residents are allowed to display? Wind chimes may be a soothing sound to some but grating to others.
  • Many new condo buildings are home to people and pets. Do residents need a refresher on the rules governing pets on patios, in shared spaces or running loose through the building's front garden?
  • Watching the big game or HBO is a priority for many people, but unsightly satellite dishes can be a source of contention. Are all residents aware of your building's restrictions or prohibitions on such devices?
  • Bringing the boat or RV home on the weekends may sound like a good idea, but there is rarely room to park these types of vehicles in condominium parking spots.
  • Late night parties are inevitable when the days grow longer and the nights grow warmer. What are the rules about late-night noise and parties?

Part of the new condo lifestyle is learning to enjoy living in close proximity to your neighbours. Now is a great time to remind your community about the good neighbour policies and rules in place for your new condo development.
